Federal law
Cannabis sits in Schedule I of the Controlled Substances Act. Federal law treats a THC vape cartridge the same as flower or edibles. No federal statute creates a legal path for state-licensed THC vapes.

Three state categories

- Check age rules. Medical states allow patients under 21 with a card. Adult-use states set the floor at 21.
Convenience and the rules
A cartridge needs no grinding, rolling, or prep. That portability pushed vapes to a large share of legal cannabis sales. Convenience does not change the statute. Carrying a cartridge from a legal state into a prohibited state is a federal offense and often a state offense. Delivery rules split the same way. Some states allow delivery statewide. Some limit it to medical patients. Some ban it.
What to watch
Federal rescheduling to Schedule III was proposed in 2024, with a DEA hearing process set for 2025. Schedule III would not make THC vapes legal nationwide. Schedule III drugs require a prescription. Congress also debates hemp cannabinoid rules, and state legislatures file new bills each session.
